w\u00e4hrend der \u00dcberpr\u00fcfung der Stammanmeldung<\/strong><\/p>\n<p>Mit Wirkung vom 1. April 2023 hat das Japanische Patentamt (JPA) eine neue Praxis eingef\u00fchrt, wonach die Pr\u00fcfung bestimmter Teilanmeldungen ausgesetzt wird, die mit oder nach der Beschwerde in der Stammanmeldung eingereicht werden. Diese \u00c4nderung zielt darauf ab, den Anmeldern effizientere und effektivere Anmeldestrategien zu bieten.<\/p>\n<ol>\n<li>\u00dcberblick<\/li>\n<\/ol>\n<p>Seit dem 1. April 2023 wendet das JPA Par. 54(1) des Patentgesetzes an, um die Pr\u00fcfung zul\u00e4ssiger Teilanmeldungen auf Antrag der Anmelderin so lange auszusetzen, bis ein erstinstanzlicher Pr\u00fcfer in der Nachpr\u00fcfungsphase ein Patent erteilt hat oder das Ergebnis der Beschwerde in der Stammanmeldung feststeht.<\/p>\n<ol start=\"2\">\n<li>Zul\u00e4ssige Anmeldungen<\/li>\n<\/ol>\n<p>Zul\u00e4ssig sind Teilanmeldungen, f\u00fcr die am oder nach dem 1. April 2023 Pr\u00fcfungsantrag gestellt wurde und die alle der folgenden Kriterien erf\u00fcllen:<\/p>\n<p>(1) Die Teilanmeldung wurde nach der Ausgabe des Zur\u00fcckweisungsbeschlusses der Stammanmeldung eingereicht,<\/p>\n<p>(2) Die Stammanmeldung befindet sich im Beschwerdeverfahren (einschlie\u00dflich der Nachpr\u00fcfung durch den erstinstanzlichen Pr\u00fcfer) gegen den Zur\u00fcckweisungsbeschluss, und<\/p>\n<p>(3) Es ist vorteilhaft, das Ergebnis des Beschwerdeverfahrens (oder der Nachpr\u00fcfung durch den erstinstanzlichen Pr\u00fcfer) abzuwarten.<\/p>\n<ol start=\"3\">\n<li>Antragstellung<\/li>\n<\/ol>\n<p>Um die Aussetzung der Pr\u00fcfung der Teilanmeldung zu beantragen, muss die Anmelderin innerhalb von f\u00fcnf Arbeitstagen ab dem Datum der Stellung des Pr\u00fcfungsantrags f\u00fcr die in Frage kommende Teilanmeldung einen Antrag auf Anwendung von Par. 54(1) des Patentgesetzes stellen und die entsprechenden Informationen \u00fcber ein spezielles Online-Formular \u00fcbermitteln.<\/p>\n<ol start=\"4\">\n<li>Wirkung<\/li>\n<\/ol>\n<p>Nachdem das JPA festgestellt hat, ob die Teilanmeldung f\u00fcr diese Praxis in Frage kommt, benachrichtigt es die Anmelderin per E-Mail und erstellt ein Bearbeitungsdokument. Wenn die Teilanmeldung als zul\u00e4ssig erachtet wird, wird die Pr\u00fcfung f\u00fcr bis zu drei Monate nachdem eines der folgenden Ereignisse eingetreten ist, ausgesetzt:<\/p>\n<p>(1) Der Anmelderin wird eine Kopie des Erteilungsbeschlusses als Ergebnis der Nachpr\u00fcfung durch den erstinstanzlichen Pr\u00fcfer zugestellt,<\/p>\n<p>(2) Der Anmelderin wird eine Kopie der ersten Entscheidung \u00fcber die Beschwerde zugestellt, oder<\/p>\n<p>(3) Die Beschwerde wird zur\u00fcckgezogen oder zur\u00fcckgewiesen.<\/p>\n<p>Nach Ablauf der Aussetzungsfrist wird die Pr\u00fcfung in der \u00fcblichen Reihenfolge fortgesetzt. Auch w\u00e4hrend der Aussetzung kann die Anmelderin die Unterlagen der Teilanmeldung auf der Grundlage von Artikel 17(2) des Patentgesetzes \u00e4ndern.<\/p>\n<ol start=\"5\">\n<li>Unsere Empfehlung<\/li>\n<\/ol>\n<p>Bei wichtigen Anmeldungen empfehlen wir dringend, diese neue Praxis anzuwenden, wenn die Anmelderin einen Zur\u00fcckweisungsbeschluss erh\u00e4lt und beschlie\u00dft, eine Beschwerde einzulegen. Unserer Ansicht nach ist diese neue Praxis sehr n\u00fctzlich, da sie die Nutzung von Teilanmeldungen als R\u00fcckfallposition weiter verbessert. Beispielsweise kann die Anmelderin selbst nach Erhalt der Beschwerdeentscheidung oder nach Erhalt des Erteilungsbeschlusses als Ergebnis der Nachpr\u00fcfung durch den erstinstanzlichen Pr\u00fcfer eine Frist von mindestens drei Monaten erhalten, um die Teilanmeldung unter Ber\u00fccksichtigung des Ergebnisses der Beschwerde zu \u00e4ndern und zu versuchen, weitere Schutzrechte f\u00fcr patentf\u00e4hige Erfindungen zu erlangen, die im Erteilungsverfahren der Stammanmeldung vernachl\u00e4ssigt wurden.<\/p>\n<\/div><\/section><br \/>\n<div  class='avia-button-wrap
