Nach erfolgreicher formaler und materieller Pr\u00fcfung ergeht eine Eintragungsbewilligung, woraufhin das Design nach Entrichtung der Eintragungsgeb\u00fchr eingetragen wird. Wenig sp\u00e4ter nach der Eintragung folgt die Ver\u00f6ffentlichung des Designs im Designblatt. Diese Ver\u00f6ffentlichung erfolgt gew\u00f6hnlich innerhalb von 1 bis 3 Monaten nach Eintragung des Designs.<\/p>\n<p>Die Geheimhaltung erlaubt es jedoch, diese relativ kurze Zeitspanne zwischen der Eintragung und Ver\u00f6ffentlichung des Designs zu verl\u00e4ngern. Durch die Beantragung der Geheimhaltung, ist eine Aufschiebung der Bekanntmachung f\u00fcr bis zu 3 Jahre ab dem Eintragungstag m\u00f6glich.<\/p>\n<p><strong>Wie effektiv ist die Geheimhaltung?<\/strong><\/p>\n<p>Die Beantragung der Geheimhaltung erm\u00f6glicht das Design selbst nach Eintragung geheim zu halten, z.B. wenn die \u00f6ffentliche Bekanntmachung des Designs noch nicht gew\u00fcnscht wird, da das Produkt noch nicht auf dem Markt ist.<\/p>\n<p>Auch in Japan gilt das so genannte \u201eFirst-to-File\u201c Prinzip, bei der eine m\u00f6glichst fr\u00fche Einreichung der Anmeldung zu bevorzugen ist. Eine fr\u00fche Anmeldung kann jedoch dazu f\u00fchren, dass das Design fr\u00fcher als erwartet ver\u00f6ffentlicht wird. In solchen F\u00e4llen ist die Beantragung der Geheimhaltung eine wirksame M\u00f6glichkeit, die Bekanntmachung des Designs aufzuschieben.<\/p>\n<p><strong>Wie kann die Geheimhaltung beantragt werden?<\/strong><\/p>\n<p>Die Aufschiebung der Bekanntmachung im Designblatt kann bereits bei der Einreichung der Anmeldung beantragt werden, wobei der Zeitraum der gew\u00fcnschten Aufschiebung in dem Anmeldeantrag angegeben werden muss.<\/p>\n<p>Wie oben beschreiben, ist die Eintragungsgeb\u00fchr nach Erhalt des Eintragungsbeschlusses zu entrichten. Zu diesem Zeitpunkt besteht eine zweite Gelegenheit, die Aufschiebung der Bekanntmachung zu beantragen. Hierzu muss der gew\u00fcnschte Zeitraum f\u00fcr die Aufschiebung bei der Einzahlung der Eintragungsgeb\u00fchr angegeben werden.<\/p>\n<p>In beiden F\u00e4llen ist eine zus\u00e4tzliche Amtsgeb\u00fchr f\u00fcr die Aufschiebung der Bekanntmachung zu entrichten.<\/p>\n<p><strong>Wie lange ist es m\u00f6glich, das eingetragene Design geheim zu halten?<\/strong><\/p>\n<p>Ein Design kann bis zu 3 Jahre ab dem Eintragungstag (nicht ab dem Anmeldetag) geheim gehalten werden. Innerhalb diesem Zeitraum ist es jederzeit m\u00f6glich, die Aufschiebungsdauer zu \u00e4ndern.<\/p>\n<p><strong>Welche Auswirkung hat die Beantragung der Geheimhaltung?<\/strong><\/p>\n<p>Mit der Eintragung des Designs wird das Japanische Patentamt das Design nur formal, d.h. ohne den Namen der Entwerfer, der Bezeichnung der Produkte und den Abbildungen, im Designblatt ver\u00f6ffentlichen:<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-4946\" src=\"https:\/\/se1910.com\/wpadmin\/wp-content\/uploads\/2022\/05\/secret-design1-213x300.png\" alt=\"\" width=\"213\" height=\"300\" srcset=\"https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design1-213x300.png 213w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design1-450x635.png 450w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design1.png 460w\" sizes=\"(max-width: 213px) 100vw, 213px\" \/><\/p>\n<p>Nach Ablauf des Aufschiebungszeitraums, werden die Abbildungen und die weiteren Angaben nachtr\u00e4glich in einem weiteren Designblatt ver\u00f6ffentlicht:<\/p>\n<p><strong> <img decoding=\"async\" class=\"alignnone size-medium wp-image-4949\" src=\"https:\/\/se1910.com\/wpadmin\/wp-content\/uploads\/2022\/05\/secret-design2-213x300.png\" alt=\"\" width=\"213\" height=\"300\" srcset=\"https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design2-213x300.png 213w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design2-450x635.png 450w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/secret-design2.png 472w\" sizes=\"(max-width: 213px) 100vw, 213px\" \/><\/strong><\/p>\n<p><strong>Hat die Geheimhaltung irgendwelche Nachteile?<\/strong><\/p>\n<p>Ein Inhaber eines Designrechts, welches sich in einem \u201eGeheimhaltungsstatus\u201c befindet, kann eine einstweilige Verf\u00fcgung gegen Dritte erst <u>nach<\/u> einer schriftlichen Abmahnung durchsetzen.
