Form einer Designeintragung, mit dem ein bestimmter Bereich eines Designs gesch\u00fctzt werden kann.<\/p>\n<p><strong>Wie effektiv ist ein Teil-Design?<\/strong><\/p>\n<p>Die \u00c4hnlichkeit von Designs wird aufgrund des Gesamteindrucks bewertet. Selbst wenn einzelne Bereiche eines Designs identisch aussehen, aber der Gesamteindruck sich von anderen Designs unterscheidet, k\u00f6nnten die Designs als unterschiedlich beurteilt werden.<\/p>\n<p>Es k\u00f6nnte daher Dritten m\u00f6glich sein, einzelne Bereiche des Designs nachzuahmen, wobei die anderen Bereiche ver\u00e4ndert werden. Durch ein Teil-Design ist es m\u00f6glich solche Nachahmungen zu unterbinden, da nur ein einziger Teil eines gesamten Designs gesch\u00fctzt ist.<\/p>\n<p><strong>Wie kann ein Teil-Design angemeldet werden?<\/strong><\/p>\n<p>Sofern die Zeichnungen nur durch durchgezogene Linien dargestellt wurden, ist es nicht m\u00f6glich eine Designanmeldung f\u00fcr ein gesamtes Design nach der Einreichung in eine Anmeldung f\u00fcr ein Teil-Design umzuwandeln.<\/p>\n<p>Der beantragte Schutzbereich muss mit durchgezogenen Linien und der nichtbeanspruchte Bereich mit gestrichelten Linien dargestellt werden:<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-4796\" src=\"https:\/\/se1910.com\/wpadmin\/wp-content\/uploads\/2022\/05\/partial1-282x300.png\" alt=\"\" width=\"282\" height=\"300\" srcset=\"https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/partial1-282x300.png 282w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/partial1-450x478.png 450w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/partial1.png 467w\" sizes=\"(max-width: 282px) 100vw, 282px\" \/><\/p>\n<p>Alternativ ist es auch m\u00f6glich den Schutzbereich in einer anderen Farbe zu kennzeichnen, um die gesch\u00fctzten und nicht gesch\u00fctzten Bereiche klarzustellen:<\/p>\n<p><img decoding=\"async\" class=\"alignnone size-medium wp-image-4799\" src=\"https:\/\/se1910.com\/wpadmin\/wp-content\/uploads\/2022\/05\/partial2-220x300.png\" alt=\"\" width=\"220\" height=\"300\" srcset=\"https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/partial2-220x300.png 220w, https:\/\/se1910.com\/wp-content\/uploads\/2022\/05\/partial2.png 327w\" sizes=\"(max-width: 220px) 100vw, 220px\" \/><\/p>\n<p>Selbst wenn der Schutzbereich in einen oder mehreren Ansichten nicht sichtbar ist, kann die Einreichung von aller sechs Seiten dennoch erforderlich sein. Das nachfolgende Beispiel zeigt ein Teil-Design einer Gl\u00fchbirne. Priorit\u00e4tsanmeldung<\/strong><\/p>\n<p>Im Falle einer Priorit\u00e4tsanmeldungen die Schutz nur f\u00fcr einen bestimmten Bereich eines Designs beantragt, ist es m\u00f6glich das Priorit\u00e4tsrecht zu beanspruchen, sofern der beanspruchte und nichtbeanspruchte Schutzbereich ausreichend (z.B. durch Linien oder Farben) gekennzeichnet ist.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Gibt es Nachteile eines Teil-Designs?<\/strong><\/p>\n<p>Die Erfolgsaussichten einer Eintragung eines Teil-Designs sind geringer als bei einer Anmeldung f\u00fcr ein gesamtes Design, da der Pr\u00fcfer nur die beanspruchten Bereiche des Teil-Designs auf bereits \u00f6ffentlich bekannte Designs pr\u00fcft.<\/p>\n<p>Zum Beispiel k\u00f6nnte der Pr\u00fcfer das nachfolgende Design gegen das oben gezeigte Design entgegenhalten, da f\u00fcr die Form der Fu\u00df kein Schutz beansprucht wurde und somit beiden Designs identisch
