f\u00fcr ein Design, das vor Einreichung offenbart wurde, wird vom Japanische Patentamt aufgrund von fehlender Neuheit zur\u00fcckgewiesen.<\/p>\n<p>Wird die Anmeldung jedoch innerhalb der Neuheitsschonfrist eingereicht, gilt das Design als neu, auch wenn dies bereits offenbart wurde. Daher erm\u00f6glich die Neuheitsschonfrist die Eintragung eines Designs, das der \u00d6ffentlichkeit bereits vor der Anmeldung zug\u00e4nglich wurde.<\/p>\n<p>Die Neuheitsschonfrist betr\u00e4gt 12 Monate ab dem Tag der ersten Offenbarung.<\/p>\n<p>Um diese Neuheitsschonfrist beanspruchen zu k\u00f6nnen, m\u00fcssen die folgenden Voraussetzungen erf\u00fcllt sein:<\/p>\n<p><strong>1. Die Anmeldung muss innerhalb von 12 Monaten nach dem Tag der ersten Offenbarung zusammen mit einem Antrag zur Beanspruchung der Neuheitsschonfrist beim Japanischen Patentamt eingereicht werden<\/strong><\/p>\n<p>Sobald das Design der \u00d6ffentlichkeit zug\u00e4nglich ist, muss die Anmeldung innerhalb von 12 Monaten ab dem Tag der ersten Offenbarung beim japanischen Patentamt eingereicht werden.<\/p>\n<p><u>Achtung: <\/u><\/p>\n<p>Bei einer Nachanmeldung gem\u00e4\u00df PV\u00dc \u00e4ndert sich die Neuheitsschonfrist nicht d.h. sie betr\u00e4gt 12 Monate ab dem Tag der ersten Offenbarung.<\/p>\n<p>Des Weiteren muss die Neuheitsschonfrist bei der Einreichung der Designanmeldung beantragt werden. Eine nachtr\u00e4gliche Beanspruchung ist nicht m\u00f6glich.<\/p>\n<p><strong>2. Offenbarungen m\u00fcssen durch den Entwerfer oder seinen Rechtsnachfolger erfolgen<\/strong><\/p>\n<p>Die Offenbarung muss durch den Entwerfer oder seinen Rechtsnachfolger erfolgen, daher ist es nicht m\u00f6glich die Neuheitsschonfrist bei einer Offenbarung durch Dritte zu beantragen.<\/p>\n<p><strong>3. Offenbarungen d\u00fcrfen nicht in einem Amtsblatt erfolgen<\/strong><\/p>\n<p>Bei der Markteinf\u00fchrung eines Produkts wird fast jede Art von Ver\u00f6ffentlichung akzeptiert (z.B. Pressemitteilungen, Markttests usw.). Ver\u00f6ffentlichungen in einem Design- oder Patentblatt sind jedoch von der Neuheitsschonfrist ausgeschlossen, sodass es erforderlich ist die Designanmeldung vor einer solchen Ver\u00f6ffentlichung einzureichen, auch wenn diese innerhalb der Neuheitsschonfrist liegt.<\/p>\n<p><strong>4. Offenbarungen gegen den Willen des Entwerfers oder Rechtsnachfolgers<\/strong><\/p>\n<p>Nach Artikel 4, Absatz 1 JDesignG kann ein Design, das gegen den Willen des Entwerfers oder seines Rechtsnachfolgers zug\u00e4nglich gemacht wurde, eingetragen werden, sofern die Voraussetzungen f\u00fcr Beanspruchung der Neuheitsschonfrist erf\u00fcllt sind.<\/p>\n<p><strong>5. Erkl\u00e4rung und Nachweis \u00fcber die Art und den Zeitpunkt der Offenbarungen<\/strong><\/p>\n<p>Innerhalb von 30 Tagen ab dem Anmeldetag, muss eine schriftliche Erkl\u00e4rung mit Nachweisen \u00fcber die Art und den Zeitpunkt der Offenbarungen eingereicht werden. Erfahrungsgem\u00e4\u00df ist eine Kopie aus z.B. einer Zeitschrift, Zeitung oder dem Internet als Nachweis ausreichend.
