itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Der Gesetzesentwurf f\u00fcr die teilweise Revision des Patentgesetzes wurde am 10. Mai 2019 im Kabinett beschlossen und verabschiedet und am 17. Mai 2019 bekanntgegeben.<\/p>\n<p>Durch diese Revision wird ein neues System zur Sammlung von Beweisen geschaffen, auf dessen Basis Experten die M\u00f6glichkeit haben, in Produktionsst\u00e4tten Vor-Ort-Untersuchungen durchzuf\u00fchren, die f\u00fcr die Beweisf\u00fchrung in Verletzungsf\u00e4llen notwendig sind. Des Weiteren werden die Berechnungsrichtlinien f\u00fcr Schadensersatzbetr\u00e4ge \u00fcberarbeitet (gleiche \u00c4nderungen werden auch jeweils im Gebrauchsmuster-, Design- und Markengesetz vorgenommen) und der Schutzumfang f\u00fcr Designs erweitert.<\/p>\n<p>Die oben genannten Revisionen sollen innerhalb eines Jahres ab Bekanntgabe umgesetzt werden.<\/p>\n<p>I. Teilweise Revision des Patentgesetzes<\/p>\n<p>1. Schaffung eines Systems, wodurch neutrale Experten Vor-Ort-Untersuchungen durchf\u00fchren k\u00f6nnen<\/p>\n<p>Es wird ein System geschaffen, wonach bei Patentverletzungsverdacht der Betroffene nach Erhebung der Verletzungsklage beantragen kann, dass vom Gericht bestellte neutrale Experten in den Produktionsst\u00e4tten des Verletzenden Vor-Ort-Untersuchungen, die f\u00fcr die Beweisf\u00fchrung der Verletzung notwendig sind, durchf\u00fchren und dem Gericht einen Bericht vorlegen (Art. 105bis PatG u.a.).<\/p>\n<p>2. \u00dcberarbeitung der Berechnungsrichtlinien f\u00fcr Schadensersatzbetr\u00e4ge<\/p>\n<p>a) Bisher war es nicht m\u00f6glich, den Teil des Profits des Verletzenden einzufordern, der die Produktionskapazit\u00e4ten des Patentinhabers \u00fcbersteigt. Diesbez\u00fcglich wird nun theoretisch vorausgesetzt, dass dem Verletzenden eine Lizenz f\u00fcr diesen Teil vorlag, sodass es nun m\u00f6glich sein wird, einen Schadensersatz, welcher der Lizenzgeb\u00fchr entspricht, zu fordern (neuer Art. 102 Par. 1(2) PatG).<\/p>\n<p>b) F\u00fcr die Berechnung des Schadensersatzes, welcher der Lizenzgeb\u00fchr entspricht, kann eine Lizenzgeb\u00fchr, die unter der Voraussetzung, dass eine Verletzung vorliegt, ausgehandelt worden w\u00e4re, herangezogen werden (d.h. unter Umst\u00e4nden eine h\u00f6here Lizenzgeb\u00fchr als die eines normalen Lizenzvertrages) (neuer Art. 102 Par. 4 PatG).<\/p>\n<p>Die \u00c4nderungen unter 2. werden auch jeweils im Gebrauchsmuster-, Design- und Markengesetz vorgenommen.<\/p>\n<p>II. Teilweise Revision des Designgesetzes<\/p>\n<p>1. Erweiterung des Schutzumfangs<\/p>\n<p>Es k\u00f6nnen nun auch Bilder, die nicht auf Gegenst\u00e4nden aufgebracht sind, z.B. in einer Cloud gespeicherte und \u00fcber ein Netzwerk zur Verf\u00fcgung gestellte Bilder, Au\u00dfenansichten von Geb\u00e4uden oder Innenausstattungen als Designs gesch\u00fctzt werden (Art. 2 DesignG).<\/p>\n<p>2. \u00dcberarbeitung des Systems f\u00fcr verwandte Designs (System, dass die Eintragung von Designs zul\u00e4sst, die dem eigenen angemeldeten oder eingetragenem Design (Hauptdesign) \u00e4hnlich sind) (Art. 10 DesignG)<\/p>\n<p>Um es zu erm\u00f6glichen, mehrere Designs, die unter einem einheitlichen Konzept entwickelt wurden, zu registrieren<\/p>\n<p>a) wird die Frist f\u00fcr die Anmeldung von verwandten Designs auf 10 Jahre ab Anmeldetag des Hauptdesigns verl\u00e4ngert (bisher: bis zur Offenlegung des eingetragenen Hauptdesigns, d.h. ca. 8 Monate ab Anmeldetag), und<\/p>\n<p>b) werden auch Designs zur Eintragung bewilligt, die nur den verwandten Designs \u00e4hnlich sind.<\/p>\n<p>3. \u00c4nderung der Laufzeit<\/p>\n<p>Die Laufzeit wird von \u201e20 Jahre ab Eintragung\u201c auf \u201e25 Jahre ab Anmeldetag\u201c erstreckt (Art. 21 DesignG).<\/p>\n<p>4. Vereinfachung des Anmeldeverfahrens<\/p>\n<p>a) Es k\u00f6nnen mehrere Designs in einer Anmeldung zusammengefasst werden.<\/p>\n<p>b) Um eine flexible Bezeichnung der Gegenst\u00e4nde zu erm\u00f6glichen, werden die Klassifizierungen abgeschafft.<\/p>\n<p>5.
