Patentgesetzes usw. wurden die Geb\u00fchren des Japanischen Patentamtes f\u00fcr Patente und Marken am\u00a01. April 2016 (der &#8220;<strong>Stichtag&#8221;<\/strong>) revidiert. Dar\u00fcber hinaus wurde die Handhabung von Fristverl\u00e4ngerungen zur Bescheidserwiderung f\u00fcr Patent- und Markenanmeldungen ge\u00e4ndert.<\/p>\n<p>Im Folgenden erl\u00e4utern wir die \u00c4nderungen im Detail.<\/p>\n<h3>I. Revidierte Geb\u00fchren<\/h3>\n<h4>1. Teil der Individualgeb\u00fchren) f\u00fcr Anmeldungen (ggf. nach Fristverl\u00e4ngerung), Schutzerstreckungsantr\u00e4ge und zeitgerechte Erneuerungsantr\u00e4ge, die am oder nach dem Stichtag (<strong><u>1. April 2016<\/u><\/strong>) f\u00e4llig waren\u00a0und auch am oder nach dem Stichtag eingezahlt wurden. Soweit also die Einzahlung vor dem Stichtag trotz sp\u00e4terer F\u00e4lligkeit erfolgte, mussten\u00a0die bestehenden Geb\u00fchrenregelungen angewandt werden. Wenn Sie uns daher vor dem 31. M\u00e4rz 2016 zu einer der vorstehenden Ma\u00dfnahmen angewiesen hatten, haben\u00a0wir diese aus Kostengr\u00fcnden nach dem Stichtag veranlasst, es sei denn, Sie hatten\u00a0uns explizit zu einer fr\u00fchzeitigen Einzahlung angewiesen oder es bestanden\u00a0sonstige besondere Umst\u00e4nde.<\/p>\n<p>Bei Fragen in diesem Zusammenhang stehen wir Ihnen selbstverst\u00e4ndlich jederzeit gerne zur Verf\u00fcgung.<\/p>\n<h3>II. Verl\u00e4ngerung der Frist f\u00fcr eine Beantwortung einer Mitteilung von Zur\u00fcckweisungsgr\u00fcnden (Bescheidserwiderung)<\/h3>\n<h4><span style=\"line-height: 1.5;\">1. Patentanmeldungen<\/span><\/h4>\n<p><strong>(1) Antrag auf eine Fristverl\u00e4ngerung,<br \/>\nder <u>innerhalb der Frist f\u00fcr die Bescheidserwiderung<\/u> gestellt wird<\/strong><\/p>\n<p>Zuvor wurde\u00a0auf Antrag eine Verl\u00e4ngerung der Frist um jeweils einem Monat genehmigt, wenn ein Grund vorlag, dass der Amtsbescheid nicht innerhalb der vorgegebenen Frist beantwortet werden konnte. Nach dem Inkrafttreten des revidierten Patentgesetzes usw. ist folgende Option vorgesehen:<\/p>\n<p>&lt;F\u00fcr Anmelder ohne Wohnsitz, Sitz und Niederlassung in Japan&gt;<\/p>\n<p><u>Auf Antrag wird eine Verl\u00e4ngerung der Erwiderungsfrist von zwei Monaten<\/u> genehmigt und durch einen zweiten Antrag wird eine weitere Verl\u00e4ngerung um einen Monat genehmigt (d.h. Fristverl\u00e4ngerung von maximal drei Monaten). Eine gleichzeitige Einreichung des ersten und zweiten Antrags ist m\u00f6glich. <u>Eine Begr\u00fcndung f\u00fcr den Antrag ist nicht notwendig<\/u>.<\/p>\n<p><strong>(2) Antrag auf eine Fristverl\u00e4ngerung,<br \/>\nder <u>nach Ablauf der Frist f\u00fcr die Bescheidserwiderung<\/u> gestellt wird<\/strong><\/p>\n<p>Nach Inkrafttreten des revidierten Patentgesetzes usw. wird eine Fristverl\u00e4ngerung auch nach Ablauf der Frist f\u00fcr die Bescheidserwiderung genehmigt, wenn ein Antrag innerhalb der daf\u00fcr vorgesehenen Frist (zwei Monate) gestellt wird. Alle Antr\u00e4ge von Anmeldern mit einem Wohnsitz, Sitz oder einer Niederlassung in Japan oder au\u00dferhalb Japans zur Verl\u00e4ngerung der Frist f\u00fcr die Bescheidserwiderung werden genehmigt, wobei eine Verl\u00e4ngerung um bis zu zwei Monate ab Ablauf der Frist m\u00f6glich ist. Eine Begr\u00fcndung f\u00fcr den Antrag ist nicht notwendig. Bei diesem Antrag auf Fristverl\u00e4ngerung sind jedoch h\u00f6here Geb\u00fchren (JPY 51,000) als beim Antrag auf eine Verl\u00e4ngerung (Geb\u00fchr: 2,100 JPY) unter Punkt (1) erforderlich.<\/p>\n<p>Diese Fristverl\u00e4ngerung nach Ablauf der Erwiderungsfrist ist jedoch nicht m\u00f6glich, wenn bereits eine Verl\u00e4ngerung unter Punkt (1) genehmigt wurde oder wenn bereits eine Bescheidserwiderung innerhalb der urspr\u00fcnglichen Erwiderungsfrist eingereicht wurde.<\/p>\n<h4>2. Markenanmeldungen<\/h4>\n<p><strong>Antrag auf eine Fristverl\u00e4ngerung,<br \/>\nder nach Ablauf der Frist f\u00fcr die Bescheidserwiderung gestellt wird:<\/strong><\/p>\n<p>\u00c4hnlich wie bei Patentanmeldungen wurde\u00a0am oder nach dem Stichtag eine Fristverl\u00e4ngerung auch nach Ablauf der Frist f\u00fcr die Bescheidserwiderung genehmigt, wenn ein Antrag innerhalb der daf\u00fcr vorgesehenen Frist (zwei Monate) gestellt wurde\u00a0(Geb\u00fchr = JPY 4,200). F\u00fcr Details wird auf den obigen Punkt II. 1. (2) verwiesen.<\/p>\n<p>(F\u00fcr einen Antrag auf eine Verl\u00e4ngerung der Frist zur Beantwortung der Mitteilung \u00fcber die vorl\u00e4ufige Schutzverweigerung in Bezug auf die internationale Markenanmeldung ist ebenfalls der oben genannte Inhalt g\u00fcltig.)<\/p>\n<h4>3. Ausnahmen<\/h4>\n<p>Die oben genannten Punkte 1. und 2. gelten nur f\u00fcr Anmeldungen, bei denen die Frist f\u00fcr die Bescheidserwiderung (einschlie\u00dflich der vor dem Stichtag erlassenen Bescheide) am oder nach dem Stichtag abgelaufen ist\u00a0und eine Verl\u00e4ngerung der Erwiderungsfrist (d.h. in Bezug auf den Punkt 1.
