itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock'  itemprop=\"text\" ><p>Der Entwurf f\u00fcr die teilweise Revision des Patentgesetzes und anderer Gesetze, vom japanischen Kabinett am 13. M\u00e4rz 2015 vorgelegt, wurde am 3. Juli 2015 vom Parlament verabschiedet und am 10. Juli 2015 als Gesetz No. 55 verk\u00fcndet.<\/p>\n<p>Nachfolgend geben wir einen \u00dcberblick \u00fcber die \u00c4nderungen. Die revidierten Gesetze treten voraussichtlich am 01. April 2016 in Kraft.<\/p>\n<p><strong>1. \u00c4nderung des Systems f\u00fcr Arbeitnehmererfindungen<\/strong><\/p>\n<p>Um einen Anreiz f\u00fcr Forschungsleistungen zu schaffen sowie zur Steigerung der Konkurrenzf\u00e4higkeit von Firmen wird Folgendes bestimmt:<\/p>\n<p>i) Das Recht auf die Erteilung eines Patents f\u00fcr eine Arbeitnehmererfindung liegt von Beginn an beim Arbeitgeber, vorausgesetzt, der Arbeitnehmer und der Arbeitgeber einigen sich dazu.<\/p>\n<p>ii) Der Minister f\u00fcr Wirtschaft, Handel und Industrie wird Richtlinien f\u00fcr eine entsprechende Einigung vorlegen.<\/p>\n<p>iii) Arbeitnehmererfinder haben f\u00fcr eine Erfindung Anspruch auf eine finanzielle oder andere Verg\u00fctung.<\/p>\n<p><strong>2. \u00c4nderung von Jahresgeb\u00fchren und andere Geb\u00fchren<\/strong><\/p>\n<p>Jahresgeb\u00fchren werden ge\u00e4ndert um die Nutzung von Patentrechten und Markenrechten zu f\u00f6rdern. Die Jahresgeb\u00fchren f\u00fcr Patente werden beispielsweise um ca. 10% f\u00fcr jedes Jahr ab Eintragung des Patents reduziert. Die Geb\u00fchr f\u00fcr die Eintragung einer Marke wird um ca. 25% reduziert; die Jahresgeb\u00fchren f\u00fcr Marken um ca. 20%.<\/p>\n<p><strong>3. Neue Bestimmungen im Einklang mit dem Patentrechtsvertrag (PLT) und dem Singapur-Vertrag zum Markengesetz<\/strong><\/p>\n<p>Konform zu den o.g. Vertr\u00e4gen werden die Bestimmungen f\u00fcr fristgebundene Verfahrenshandlungen ge\u00e4ndert. Hierzu die folgenden Beispiele:<\/p>\n<p>i) Die Frist f\u00fcr die Einreichung einer \u00dcbersetzung einer in Japan vorl\u00e4ufig eingereichten, englischsprachigen Nachanmeldung wird um 2 Monate verl\u00e4ngert auf 4 Monate nach Ablauf der 12 monatigen Priorit\u00e4tsfrist (PV\u00dc).
