Juni 2019 sponserte S&amp;E ein Seminar zum gewerblichen<br \/>\nRechtsschutz in den USA mit dem Titel \u201eextraterritoriale<br \/>\nAnwendung f\u00fcr US-Patente: Einfluss auf die Patentpraxis japanischer Unternehmen\u201c.<\/p>\n<p>Die Referenten waren Frau Professor Toshiko<br \/>\nTakenaka, die neben ihrer Lehrt\u00e4tigkeit an renommierten Universit\u00e4ten wie der<br \/>\nKeio University Law School und der Washington University School of Law am Erhalt<br \/>\nund der Durchsetzung von Patentrechten bei der Seed IP Law Group in Seattle<br \/>\nbeteiligt ist, und Herr Paul T. Meiklejohn (US Attorney at Law),<br \/>\nau\u00dferordentlicher Professor an der University of Washington School of Law und<br \/>\nPartner in der Praxisgruppe Intellectual Property Litigation von Dorsey &amp;<br \/>\nWitney.<\/p>\n<p>In den letzten Jahren tendierten die Gerichte dazu,<br \/>\ndie extraterritoriale Reichweite von US-Patenten anzuerkennen. Im vergangenen<br \/>\nJahr best\u00e4tigte der U.S. Supreme Court ein Geschworenenurteil, wonach der<br \/>\nBeklagte zu einer Schadensersatzzahlung von 93,4 Millionen Dollar f\u00fcr weltweite,<br \/>\ndurch seine Handlung verursachte Sch\u00e4den verurteilt worden war, weil er eine<br \/>\nKomponente einer patentierten Erfindung aus den USA nach Gro\u00dfbritannien geliefert<br \/>\nhatte. Wie dieser Fall zeigt, steigt auch das Risiko, dass bestimmte Handlungen<br \/>\nin Japan als Verletzung eines Patents in den USA angesehen werden. Es ist zwar<br \/>\nnotwendig, Ma\u00dfnahmen zur Vermeidung dieser Verletzung zu ergreifen, aber wir ben\u00f6tigen<br \/>\nauch Ma\u00dfnahmen, um das Recht auf eine Nutzung von US-Patenten zu erwerben, bei<br \/>\ndenen die Schadensersatzsumme hoch ist.<\/p>\n<p>Frau Takenaka hielt einen Vortrag \u00fcber das \u201eTerritorialit\u00e4tsprinzip<br \/>\ndes US-Patentrechts und extraterritoriale Anwendung &#8211; Eine vergleichende Studie\u201c,<br \/>\nworin sie den Grundgedanken, der der extraterritorialen Anwendung des<br \/>\nUS-Patentrechts zugrunde liegt, Territorialit\u00e4tsprinzip und extraterritoriale<br \/>\nAnwendung sowie direkte und indirekte Verst\u00f6\u00dfe gegen das US-Patentrecht im<br \/>\nVergleich zum deutschen und japanischen Patentrecht erl\u00e4uterte. Herr Meiklejohn<br \/>\nhielt einen Vortrag \u00fcber die \u201eDirekte und indirekte Verletzung von US-Patenten\u201c<br \/>\nund stellte zahlreiche Pr\u00e4zedenzf\u00e4lle direkter und indirekter Verletzungen vor.<br \/>\nEr erkl\u00e4rte auch das Know-how, um solche Verst\u00f6\u00dfe zu vermeiden und worauf bei<br \/>\nder Aufstellung von Patentanspr\u00fcchen und der Erstellung von Beschreibungstexten<br \/>\nzu achten ist, um die extraterritoriale Anwendung zu nutzen.<\/p>\n<\/div><\/section><\/div>\n<style type=\"text\/css\" data-created_by=\"avia_inline_auto\"
